EVIDENCE-BASED SENTENCTING

Why This Matters

Taking away someone’s innate freedom by incarcerating them is a drastic measure that should be done only when the benefits outweigh the harm.

Following evidence-based practices to guide effective sentencing will build thriving communities.

Sentencing Commission

Research on Michigan sentencing found disparities and sentence lengths that are outliers compared to other states. Better sentencing guidelines would change that.

Habitual Sentencing

Habitual sentencing enhancements can extend a maximum sentence by up to 100 percent, but the statute has been interpreted more broadly than necessary to serve its goals. We can fix this.

Juvenile Life Without Parole

The U.S. is the only country sentencing children to life in prison without any chance of parole; among the states, Michigan has one of the largest populations serving this sentence. Let’s change that.

Second Look

Michigan’s long prison sentences lead to an aging, expensive prison population and staffing shortages. One policy change may help solve both problems.

Productivity Credits

If we allow people to reduce sentences by earning Productivity Credits for getting a GED or job training, we create incentives to prepare for the future.

Good Time

“Time off for good behavior” doesn’t exist in Michigan. If we bring it back, it could help address overcrowding and staffing shortages and make prisons a safer place to work.
